CONCERNING
AMENDMENT TO REGULATION OF THE MINISTER OF FINANCE NO. 236/PMK.011/2008 CONCERNING STIPULATION OF IMPORT DUTY TARIFF WITHIN THE FRAMEWORK OF ASEAN-KOREA FREE TRADE AREA (AK-FTA)

Attachment

Considering:

a. that based on Regulation of the Minister of Finance No. 236/PMK.011/2008 concerning Stipulation of Import Duty Tariff Within the Framework of ASEAN Korea Free Trade Area (AK-FTA), has stipulated import duty tariff on import from Republic of Korea and ASEAN countries in the framework ASEAN-Korea Free Trade Area (AK-FTA) for period 2009 until 2012;
b. that in the framework to apply reciprocal action in imported goods from Republic of Korea in the framework ASEAN-Korea Free Trade Area (AK-FTA) as arranged in paragraph 7 annex 2 of Agreement on Trade in Goods Under The Framework Agreement on The Comprehensive Economic Cooperation Among The Government of The Members Countries of The Association of South East Asian Nations and The Republic of Korea concerning Modality for Tariff Reduction/ Elimination for Tariff Lines Placed in The Sensitive Track, it is necessary to amend stipulation of import duty tariff of many tariff posts based on provision as described in clause a.;
c. that based on consideration as described in a. and b. above, and in the framework to implement provision in Article 13 paragraph (3) of Law No. 10/1995 concerning Customs that is amended by Law No. 17/2006, it is necessary to stipulate Regulation of the Minister of Finance concerning Amendment to the Regulation of the Minister of Finance No. 236/PMK.011/2008 concerning Stipulation of Import Duty Tariff Within the Framework of ASEAN Korea Free Trade Area (AK-FTA);

In view of:

1. Law No. 10/1995 concerning Customs (Statute Book No. 75/1995, Supplement to Statute Book No. 3612) that is amended by Law No. 17/2006 (Statute Book No. 93/2006, Supplement to Statute Book No. 4661);
2. Presidential Decision No. 84/P/2009:
3. Regulation of the Minister of Finance No. 110/PMK.010/2006 concerning the System of Classifying Goods and Imposing Duties on Imported Goods that is several times amended the latest by Regulation of the Minister of Finance No. 233/PMK.011/2008;
4. Regulation of the Minister of Finance No. 236/PMK.011/2008 concerning Stipulation of Import Duty Tariff Within the Framework of ASEAN Korea Free Trade Area (AK-FTA);

HAS DECIDED:

To stipulate;

REGULATION OF THE MINISTER OF FINANCE CONCERNING AMENDMENT TO REGULATION OF THE MINISTER OF FINANCE NO. 236/PMK.011/2008 CONCERNING STIPULATION OF IMPORT DUTY TARIFF WITHIN THE FRAMEWORK OF ASEAN-KOREA FREE TRADE AREA (AK-FTA)

Article I

To amend certainty of import duty for tariff post as stipulated in Attachment for the Regulation of the Minister of Finance No. 236/PMK.011/2008 concerning Stipulation of Import Duty Tariff Within the Framework of ASEAN Korea Free Trade Area (AK-FTA) become as stipulated in this Attachment for the Regulation of the Minister of Finance.

Article II

This Regulation of the Minister of Finance shall come into force as from the date of stipulation.

For public cognizance, this Regulation of the Minister of Finance shall be announced by placing it in the State Gazette of the Republic of Indonesia.
